ok, here's the deal. we have been living in this place for about 5 months and suddenly out of the blue the landlady says that we either come up with 1600 buck or she is moving in. she calls this morning to tells us that either way she is moving in. leagaly is it true that if she accepts the money she cant kick us out? its a month to month lease. and over the past few months she raises it to 500 bucks more, not to mention the house still needs work that was promised to be done when we moved in.

Since you are on a month to month lease, she can raise the rent, as long as she gives you 30 days notice. She can also give you 30 days notice to vacate as well. She probably raised your rent to get you to leave, and she is within her legal limits to do so.

I can only guess why your landlord did this process the long way. Probably to get more $$ if you were willing to pay before she evicted you. Start looking for a new place ASAP! Your landlord is unhappy with you for some reason.

She's raising the rents to get you to move, and she CAN do that, if you are month-to-month. If you pay as she requests, she can't do anything to you. However, she also has the right to simply terminate your tenancy with a thirty day notice to you.

I'd start looking for other accommodations, since I'd venture that another rent raise is in the offing for you.

i would say she would have to give to 30 days to leave - tell her to screw her 1600. If she doesn't have it in writing,pay the same as you did last month and move at the end of the month - or don't pay at all - and let her keep the security deposit - by the time she can do anything legally, you'll be long gone
