My brother shares joint custody of his daugter with the mother. My brother gets his daughter every other week Thursday-Monday and every Thursday -Friday.That is the court order. Recently, the mother was kicked out of her home and has been living in different places from friends houses, to mens house etc. My niece is very confused, she has been sleeping on peoples floors, she has bags under her eyes, she is sad and cries a lot. She doesn't know where her home is, she is 6 years old and now her schooling is beginning to suffer too. She is missing after school activities and is having problems with her grades. The teacher has offered to tutor her after school but the mother says she has no time. My brother can't get a hold of the mother and has to return my niece tonight. He doesn't want to b/c the mother has no residence or place to live. What does he do?

We contacted friend of the court and they told us to call protective services. PS told us that they cannot do anything until they investigate the mother which they acknowldged they can't do until they find the mother, who has no phone and no home. Until then we are to return her toher mother tonight they said!

he can file for an emergency hearing with family court. they can set a temp order until the mother has a stable home.

He needs to keep the child till the mother gets things together and he has a legal and moral right to do so. If he has to get a "change in circumstances" motion filed and have it enforceable by law.

Go to court. File a petition. Take temporary custody of child until mom can straighten herself out.
