I was just carious, I am not in this situation, but I would like to know for future reference because I was almost kick out for busting my step dad in the act of smoking pot. He was going to kick me out, but my mom convinced him to let me stay.

I remember watching a show on cops. The woman called the police to have her boyfriend kicked out, they said they can't do anything without a written notice or a restraining order, does this apply to me.

Unless you hold a lease in your name and pay rent, legally you are stuffed.
Parents can give you the boot anytime, even in school age, I think welfare would find you a foster home.
My advise is, if you are old enough, MOVE now, dont ever have to live feeling insecure about your home.
Sorry to hear your having a bad time. I had to leave home early myself, its hard, but makes you stronger in the long run.
Maybe theres more of an issue with the step dad?
Busting him, (calling cops) is not a smart way to have a solid family unit. Talk things out with your mum, and hopefully she will see how you are feeling.

if you are legally an adult, they can turn you out immediately. If you are legal a child, they have to provide at least shelter and food for you, and ensure you go to school. In most states, they don't have to do anything else.
The only time they'd need a court order (if you are an adult) is if there is a contract (lease) and you have been paying rent - even then, if you are living in the same space as them, and not a guest house, or separate in-law area of the property, you would probably not get notice to quit.

The sad truth is that parents kick kids out of the house all the time regardless of their age or the circumstances in the household. (natural parents or step parents, it doesn't matter) At any one time on any day of the year there are over 100000 kids on the street that parents have kicked out for what ever reason.
Is it legal? Under 18 in most states (In some state the age is 16) NO! But it happens anyway. Over 18 your on your own baby and no notice is required. The STATE says you are of the age of majority and you are supposed to be able to support yourself.

The owner of a house can remove unwanted occupants without notice. Unless they are paying rent and have a lease. I suggest you pay by check. I also suggest you put a note on each check, for each month example- Rent payment December 1 through 30. ...

It's illegal if you are under 18 period. However, if you are older than 18 unless they are techincally your landlords as in you pay them rent to live there then they have the right to tell you to leave whenever they like, because they are the rightful owners of the house. Hope this helps.

I'm guessing you don't have some kind of contract with your parents that let you stay there, pay rent, etc. Since they're just letting you stay out of the goodness of their heart, they can absolutely kick you out with no notice.

It depends,
Have you been paying rent? If so you may have some legal rights, otherwise your a tenant at will. In other words, you are allowed to stay as long as the property owner allows you too.

When your 18 you are legal and you can be on your own.
I remind my kids this all the time. Especially when they whine about things. "When your 18 you can move out !"
You should be able to go online and look for info for the state you live in.
