and he doesn't divorce her before the surgery, does the marriage get grandfathered in as a gay marriage, even though in most states it's not legal?

Yes. Just like a HI or MA marriage is grandfathered in. Just because the woman had a sex change doesn't mean the husband will want to have sex with her man parts. A marriage is a piece of paper. Without a divorce, it will stay in effect, reguardless whether they even live together or not.

It would remain valid but only until the transgendered person legally goes through identifying themselves as the new sex. The marriage license and laws are written for the union to be a man and a woman. The couple could do a commitment ceremony or redo the vows in a location where it is legal.

No, it doesn't become a "gay" marriage.
Because if they're born a male, they are a male forever.
It doesn't matter if they change physical crap about themselves.
You can't change what God made you.
THEY ARE THE SAME GENDER FOREVER.
Who CARES what "legal" documents say.... that doesn't change the fact they were born a MALE.....
That's like saying Mr. Garrison (from South Park) is a woman after his sex change.......... I mean...... COME ON.
