Only if Bud Selig or past commissioners banned or made them illegal to use without a prescription in baseball..... That's when it is a criminal act. Some of these players acquired or used the drugs after the ban and will definitely face some type of consequence, whether it be from the DEA or local authorities plus MLB.

Does this question really need answered? The DEA has no case against anyone. Go to a police station and tell them that 10 years ago you smoked a joint and see if they can arrest you? They can't and that is why they cannot do anything about this . Thought everyone knew that?

The steriods were administered as "experimental", thereby granting the companies immunity status from the DEA. Experimental drugs are not illegal drugs.
Since experimental drugs are tested by "doctors", they write valid prescriptions.
Steriod use only becomes illegal if you use steroids without a valid prescription or to distribute them. Steroids are Schedule III substances under the Controlled Substances Act. (http://www.usdoj.gov/ndic/pubs5/5448/index.htm)

A lot of the ball players seem to have prescriptions, so it's really a matter for the medical licensing authorities.
