Ok, here goes. It's my birthday today. I got money, and I decided to buy a Zune. I got home, got it out, and downloaded the software. It doesn't work. All theparts are still together and it looks brand new. It has some finger print marks on it and you can sort of tell that it's been opened. Do you think the store will take it back, as long as I don't tell them that I opened it? I hate to lie, but I say that if they sell me a crappy product and I spend 6 hours trying to get it work, then they owe me!

Bought two Zunes yesterday for my teens. Got out to the car, looked at the receipt to see how long I had to return them if I changed my mind. Receipt says Zune can be returned within 30 days, IF the factory seal is unbroken. The boxes have little tape-like seals on them that you must break to open. If that tape has been slit, removed, or otherwise opened, forget it. Doubtful they'll take it back.

Why doesn't it work? Doesn't it have a warranty that you can legitimately take it back under? If it doesn't work then they owe you anyway and you don't have to lie about it. It isn't that hard to return something, a few years ago i had a Creative zen micro and i returned it something like 3 times (it got replaced each time) within the warranty, even though once i dropped it by accident : (
As long as it has no dents or anythign on it you should be ok.

You can probably take it back...
there is usually just a problem with taking back software because people install the software and then take it back because they don't need the disk anymore

and i got a zune from radioshack, and my brother works there and he said "if you get it and don't like it then you can't just return it"

look at the return policy though, if it says to not return it then just say you didn't open it..its not your fault that it doesnt work

It depends on the policy of returned items. Some stores do not let you return a product if it has been opened- no matter who opened it- so look at your receipt and find where it says the stores return policy.

It shouldn't matter if you opened it if it was defective out of box. As long as you have your receipt you should be good to go.

Most places only have a problem with people returning software or like that after it is opened.
