Someone wrote me a check and put a stop payment on it....would they be able to put a stop to the stop payment or reverse it so it will be cashed to their bank??

The stop payment is in effect for 6 months but I was just wondering if it was possible to put a stop to it or reverse it.

A "stop payment" is issued by the writer of the check and can be withdrawn only by him. So bring the guy to Small Claims Court and sue him for the amount of the check, court costs,bank charges and pain and suffering.He gave you the "Pain" and now you are "Suffering".

You can not reverse a stop pay on a check that you are trying to cash. If the check writer wants you to have them money, he will need to write you a new check. Even though the stop will expire in 6 months, a lot of banks will not cash a check over 6 months old. Even if they accept it, they will generally put a hold on the funds until they are sure it will clear. Besides, there is a fee charged for placing a stop on the check. If you try to reverse it, I'm sure the bank would charge the check writer again. Better to just get a new check.

I work in payroll and I do see a lot of cases where an employee reported a check lost so we put a stop on it and gave him a new one. It is fairly common for the employee to cash the stopped check at a liquor store or a convenience store that won't be able to tell that the check has been stopped. When the bank returns it to the liquor store as unpaid, the store forwards it to the check writer with a demand for payment plus fees. Not suggesting that you do this but it happens a lot.......

Take "TaxGurl" advise. Simpy ask the person who
owes you money to prepare a new check for the same
amount.

If he stopped the check because he does not want to
pay you, then thats another story.

I used to work for a bank. The stop payment has a
6 month effect since a check is valid only for 6 months
starting from the date stated in the check.
