Get a good private lawyer or a public legal aid attorney to protect your rights and for custody of your child. He deserted you and your and his child. Loss of support and loss of affection; adultry and abondonment should give you good grounds for divorce. If you have assets, protect them right away. Remember, private attorney fees can ad up if they get involved in the litigation. Don't delay or your assets may disappear.

I do not know about Colorado but I think what he did constitutes desertion no matter where you are from with that being said unless you have done something really horrible it is hard to take a baby away form the mother. you can obtain a legal divorce after one year if he refuses to sign the papers, you must get a lawyer as quick as you can and protect your assets.

Check with your lawyer. That is happen to my friend right now. The first hearing he didn't show, then this time if he doesnt show, then I am going to witness that she was there and thje divorce will be granted.

I went through this with my last wife. Ask around, get the toughest lawyer you can get, it is always worth the money. If he doesn't show, you will win if your lawyer convinces the judge to get it over with.
