Pointing a gun WILL be considered a threat of deadly force. Unless you can show you had reason to feel threatened, that will cost you your concealed handgun license.

Suppose you are wrong and you are pointing your loaded weapon at a harmless person?
Suppose you accidentally fire it, miss the person and hit someone else?
Do you think the word 'seems' will exonerate you?
You don't aim a gun unless you are going to shoot, and you don't shoot until you know, not guess they are a threat.
Have you ever thought that if you point a gun at someone, you become the person with the bad intentions?

In most states you can only use a firearm when you think you life is in danger. If you just want to scare them away and have no intentions of shooting, that is evidence you are not in fear for your life. Only brandish a weapon if you are planning to use it.

Well, it's probably one of those things...
You'd probably scare him away (unless he has a gun, too) and wouldn't get caught. It probably is against the law, but the exact laws might vary state to state.
