I could be wrong but......
The LEGAL definition of affair is specific.
There has to be PROOF... words in an email aren't PROOF exactly. (Anyone can type anything, doesn't prove it.)
A friend that's a Private Investigator told me once that "You could have sex with someone in a public place and it isn't legally an affair."
He said, proof of an affair would have to include "making an effort to conceal".... like getting a hotel room.
My ex tried to prove I was having an affair based on conversations between me and a friend.... I actually was not having an affair but our conversations were a bit dicey.
The IMs were not admitted in court because his lawyer kept asking me leading questions about "was I having an affair" and I wasn't.
His lawyer tried really hard to give me a guilt trip for TALKING to a man. But there is no law that says you can't talk to anyone you feel like talking too.....
