at the start, we had a financial agreement that we would pay 1/2 of everything but he ended up not paying any of the rent - I paid each month - and I would end up paying the utilities before they got shut off!!! Now I want to try and recoup my $$. Can I sue or even put him through Court nightmare? Please advise. The total tally in rent alone is 1/2 of 5000! We do not have it in writing and the lease is in his name but the landlord is my friend who knew of the arrangment.

It's a verbal agreement.

Gather your receipts.

The lease is in his name so I believe that any judge would side with you. You didn't even have to agree to pay half.

Sue him for the half rent and court costs. You will win.

Join the legions who 'played house' with no written agreements. You have no legal basis for lawsuit. If you try to appear in a court of law, the judge will ask for your proof that the money is owed to you. All you have is a verbal agreement, PLUS a landlord who is a friend of the person you would like to sue.

Write it off to experience, and know better next time around.

You can sue. However, your agreement is verbal and since you are the complainant, the burden of proof is on you. Hopefully having a witness to the agreement will help. Since the lease is in his name, at least you are not responsible for continuing to pay.

Next time, get it in writing.

The real estate answer is that you could recoup your half of the payments.

The life answer is to move on and do better next time.
