Ive been notocing that most people use it as a way to get more money out of you .what can i do to avoid or know if my actuall sales tax isnt just b.s. to get more money out of me.

In the United States, they should only charge it when they're in the same state as you.

If the person is in the same state they can and are probably required to. I do agree with you that some people may be collecting it and putting it in their pockets. The best you can do is to just avoid anyone who tries to do this. They have to list it in the auction page. Carefully read the page before they list. If they try to slap it on after the auction is over then open a case with Ebay because the seller would be definately breaking the rules.


As for a state requiring its citizens to pay tax on purchases they make out of state, I highly doubt that any are doing this. It would be a clear violation of the US constitution that says that interstate commerce may not be regulated by the states. Requiring out of state purchases to pay a tax to the home state of the purchaser would be a law regarding interstate commerce. States cannot pass laws dealing with this. I would not believe until someone showed me the actual law from an actual .gov site that said this.

When the seller is selling new product, as a business and lives in the same state as you.

BUT

If you read your state sales tax regulations, YOU are supposed to report (and pay tax on) ALL purchases made out of state

the only time you are charged a sales tax is when the buyer and seller are in the same state, and its one that has a tax. it equals out to be like buying something from a store in your state.

many state mandate that tax be charged if you are selling and shipping the item to the same state as the seller, as theyhave to pay tax on items sold.

if shipping to the same state. yes they are required to do so.
some people are so afraid they collect on everything.
others just as you say collect it and pocket it. but then they get caught. they get nail to the wall!
