Police are entrusted with the duty of investigation and collecting evidence to prove the guilt of the accused in a court of law and in accordance with law. For this purpose, they are entrusted with enormous powers . Too often, this power is abused and misused and torture is inflicted on any suspected person. Police often believe that this is necessary to find out the truth but then even an innocent will "confess to his crime" unable to bear the pain of third degree methods...
HOW CAN VIOLENCE BY LAW-ENFORCING AGENCIES BE JUSTIFIED ? Can the police take law into their own hands and for their own purposes ? Does Law permit this ?
What then is the solution ?

If you are talking of Indian Police, please don't expect anything worthwhile.This is the worst sector of Indian administration.
So far as custody is concerned , there has to be proper monitoring from time to time to observe and see how this is going on.I guess , in India, the NGOs are more suited for this job.
Custodial torture and in many cases resulting into cuastodial death in India is a Shame to the nation.It seems there are hardly any codes of civilised way of keeping suspected/undertrial people (male or female) in this country.The SC can play a good role in this by bringing the erring / crminal Police of this country.There were some efforts on some occasions to dig into the matter(s) relating to such inhuman act.But, ultimately everyone gets away with such crimes.One can't expect civilised norms to be pracised in such a serious matter mainly because, the corrupt / illiterate/ immoral policing and the whole investingating system are such that India has to go through this as a way of life.
Even a few honest and hardworking sincere Police Officers who try to investigate and detect the the persons responsible for this heinous crime are usually not liked by the corrupt administration of India. ..........nad, these sincere ones are sent to unimportant posts as "punishment posting".
I have no faith in Indian Indian policing.....and, what about " raping of women by the police while they are under custody?" What a shameless lot this country has to enforce / supervise law in this country?
The "code of conduct" of the police was made long ago by the colonial power and this has already outlived its utility.No one is keen enough to rewrite the whole code of conduct of the police to suit the free nation as it is today.

With apologies to Jane Austen for borrowing the first few words of my answer.It is a universally acknowledged fact that the cop shop
is the only place where the customer is always wrong.Having accepted that,it is only in
dictatorial regimes and banana republics that
custodial violence and torture are inflicted on the suspect.In India which is neither of the two types mentioned above police torture is very
common because of various factors,only two of which need mention.You have guessed it right.
Corruption and abysmal working conditions
coupled with more abysmal pay scales.The former stems from the latter.Here again,worthy of mention is a former PM's quip that corruption
is a way of life in India.When you collate the
above you will realise that it is well nigh
impossible to eradicate custodial violence and torture.But take heart from the fact that this sort of treatment is on the decline what with
even the poorest of the poor having become aware of their rights.

=before blaming the police force, why dont we public , behave better ? why give a chance to the police to behave like that ?
=let us abolish the political parties.
=let us go back to the old gold "kingdom rule", like saudi arabia.
=let the greedy, thieves, and the cruel get punished immediately by whipping and chopping of the hands infront of the public immediately,
=then the people will be happy and so also the police...
otherwise, what is happening is "left" blames the "right" and vice versa....no progress for the country....
it is our "naseeb"...wat to do ?

I cant possibly answer this question as it is too difficult to answer. Police men in India are too much corrupted. It all results from small mistakes. Good men should be employed; in the sense, they should have the capacity to distinguish good and bad.

what is wrong if me and you got beaten up or tortured a little.
don't look for problems, specially others.... and you will notice that you was not beaten up or tortured.
