Where do you live? In California, the way 261.5 penal code it would likely be a misdemeanour, but still a crime. You are forbidden from use an object, i.e. even you finger. Oral sex, give and /or received, and intercourse. (The sodomy charges are listed in 289 penal code.).

In FLA it is as follows:FLORIDA 18

The age of sexual consent is 16 for adults who are under 24 years of age,
or if the adult that is 24 years of age or older is married to the minor.

It is statutory rape if one of the participants under the age of 18 and the parent forbids them from having sex. If both are under 18 then the 3 years difference comes into play.

Depends on where you both live. State laws vary from state to state regarding age of consent.

Close in age exceptions (Wikipedia):
While some legislation dealing with age of consent sets a hard and fast age under which sexual relations are prohibited, some jurisdictions have included exceptions to this. The exception can take the form of a defense at trial on the grounds of the close age of the participants, or can be an actual close in age exemption in the law negating any charges. The latter details acceptable age ranges for consensual sex between peers that otherwise would not be legal because one or both of the participants would be below the age of consent. The age differences of these two types of legislation vary by jurisdiction, from as low as one year (as in South Australia) to as high as ten years (as in Colorado).

It depends on the legal age of consent, which varies by state. If she's below the legal age of consent in your state, even if she's willing, having sex would still be considered statutory rape.

Your perfectly ok to have "consensual" sex, because there is not 4 years between your ages, even if her parents tried to press charges for it. If it's both what you want to do then your ok, but might I suggest that you don't just because your both so young and protection doesn't always do what it's supposed to. Just enjoy each others company for now, there's plenty of time for sex later.
