My mother passed away but still receives child support checks (in her name) from my father (which he is legally obligated to continue paying despite the fact that she's deceased). Every time I go to the bank they have to "check with their legal department."

They are arrears child support payments from my father. He knows she's deceased and agreed to continue paying them. It is easier for me to simply deposit them (on her behalf) than it is to change the checks from her name to mine - which could take a while in NYC family court.

Interesting statement, which may be completely wrong -- depending upon what kind of support (current or arrears) he's paying. Does your father KNOW she's deceased? You may be obligated to notify him & you may find yourself having to re-pay him.

As long as all dealings are legal, yes. The bank has certain responsibilities as far as cashing or depositing checks.

u r sposed to open a new account under the name "estate of mary smith" and get your dad to make out the checks that way.
