If there was a trial and you were convicted then you have to answer yes regardless if there was a pardon or not. Just be honest and let them know you were pardoned.

If that was the only crime you committed, then yes.
Scooter Libby, for example, was not pardoned by GWB, but Bush commuted his sentence. He serve no jail time, but his conviction is still on his record.

oops! I think I might be wrong. Just looked up pardons and they said you record may or may not be expunged. I dont know that I understand the whole point of a pardon if that is the case.

From what I know of the law, to be pardoned, you have already been convicted. So you cannot truthfully say that you have never been convicted of a crime

I think you will still be considered to have been convicted of a crime. I do not know if a pardon will remove that from a background search. I kind of doubt it.

if you pay attention to the question it should be - do you have a criminal record for which you have not been pardoned. therefore you can answer no. that being said, I do have a criminal record and I also have a pardon, when I'm asked that question I point out that yes i do have a criminal record and that i also have a pardon, I also show them a copy of the pardon. I do this simply because I don't want them to find out from someone else, and think I tried to pull a fast one on them. A pardon means your criminal record cannot be held against you.

Whether you've been pardoned or not, the fact remains that you were convicted of a crime and withholding that info would be grounds for termination if the employer ever found out.

No you can not.

A pardon doesn't change whether you were found guilty or not, it just effects the sentence.
