I'm a promotional model and I work as an independent contractor for a variety of different marketing companies/ modeling agencies. Prior to this, I've never had any issues with not receiving payment that was due. However, I worked a tradeshow for a privately owned, out fo state modeling agency. Everything seemed legit but then I didn't receive the check when I was told that I would. I had to keep contacting the owner to ask where it was and she has continued to make excuses. I just found out that another promotional model had to sue her for money that was owed. So now that it's apparent that I might also have to sue her for what she owes me, how do I go about doing this? I know how small claims court works but since I live in Michigan and she is in Indiana, what are my options?

Laws and procedures vary from state to state and rules to inforce judgment depend on jurisdiction. It is best to go to the court and ask them directly for advice.

Did the event take place in MI?

If so, you can sue in MI, but if you win you'll have to domesticate the judgment into IN in order to collect, so it might be just as easy to go ahead and sue in IN anyway.

Get someone to call acting like a lawyer (a real lawyer if you know one)... it might scare her into paying without having to go any farther.
