Last night a car full of teenagers went into the side of my partners van on round about. The people in the car have said my partners indictor was not on, but he knows it was. Can the passengers be witnesses to this or not?

Yes anyone who saw the accident is a witness. Its best to have witnesses that weren't apart of the accident, but yes they are considered witnesses.

Passengers in a vehicle involved in an accident can be classed as witnesses,but they would probably be unreliable,for two reasons:they would tend to support the driver over the injured party,(especially if they needed a lift home:or unfortunately they died in the crash!!!

if it was side on how could they see the indicator.it would be very easy for a defence lawyer to pull apart any passenger witness statements..if there were no injuries its a simple insurance claim unless a driving without due care come up.

No they can't. Witnesses need to be independent.

Unless either you or they have independent witnesses, it will be deemed as one person's word against another and settlement will be on a 50/50 basis of uninsured losses (excess, hire changes etc).

Accident's on roundabouts are notoriously difficult to apportion blame to unless there are independent witnesses.

no, anyone involved as in the accident that were passengers do not constitute as witnesses. So their world doesn't mean anything.

My only concern is that their testimony could be regarded as a conflict of interest for people can lie. An independent witness is more reliable.

if they were there they are witnesses but of course they arent going to be on your partners side are they?

Yes the passengers can be witnesses.However there all friends so fingers crossed one of them slips up.
