Hi there,
I rented out two rooms this fall to two guy grad students to help pay my morgage, one is not a problem, the other has made my life a living hell! He destroys my kitcken equipment, uses meat tenderizers on my kitcken counter and leaves my house unlocked when we are gone because he figures that if a crook wants in they will get in. I have given him notice mentioning 6 lease violations and he is denying everything and refuses to sign the eviction notice, refuses to move out!! Besides his violations, I don't feel safe with him in the house, he is extremely arrogant, demeaning, and cracks his knuckles at me (which I think is just a bit more than having tight hand joints). I'm at wits end with him, and my family is so worried about him being in the house with me that they suggest I sell the house so I can force him out that way. I think it would be better to make an amendment to the lease that will restrict him so much that he will leave to greener pastures. Any suggestions?

He doesn't have to sign his eviction notice.

Since you are having trouble doing this yourself you can hire an eviction service, it costs about 600 bucks.

I don't know what state you live in, but in PA a tenant does not have to sign an eviction notice. Go through a local Distinct Justice and at the end of the eviction the sheriff will set his things on the street if he is still there. You might also try having him arrested for harassment. You don't need to sell your home.

Evicting a tenant that lives in the house with you is actually much easier than if they were in a house that you did not also live in. After the 30 days notice you can get an order to have them removed then they will be escorted out if it comes to that.

A. 1. Return his deposit
2. Give him 1 month notice (or whatever time period as per lease agreement)
3. If he refuses to budge after the time, call the Police to have him evicted.

See an attorney now. You do not know the law in your state. Take your lease along for him to read if he needs it. Do not give the security deposit back until he is out. That would be a very bad decision. If he does not move you will need a court order to have the sheriff remove him.

You can sue for damages based on the stipulation in the contract, given it is a written month to month contract. You would have to show visual proof on the conditions of the establishment prior to moving in and the condition after the fact. You have the right to evict them at any time though. Personally, if they were destroying a property that I owned, there would be no hesitation...finals or not.

Go to the county court house and ask for the constables office or the servers office. It will cost you about $65.00 for the initial paper then for the fees, altogether about $125,00 and they will serve him a 24 hour notice, then they Will come out and make sure he's gone, if not, they'll wait unit he picks up his things. They;'ll give him a few hours.

First of all your lease was probally illegal in the first place.

Does your mortgage allow you to rent our rooms? No it doesnt dont even look it up.

Since your rent cant be binding because you had no right to rent it, your lease isnt binding. Call the police and say he is trespassing. Dont give him 30 days. He can take you to court but the mortgage company is going to say she couldnt rent it out. Say you screwed up and didnt know. Now that you know you have to kick everybody out.

Other thought go hard ball. Have your water turned off. If your water is turned off nobody can live there. Which also will cancel your illegal rent agreement.

I dont get why you are worried, you are renting rooms when you cant. Just say I found out I cant and kick his *** out. The lender you are with will be happy to send you a letter saying you cant do this.

Let him sue if he wants, but you can kick his *** out tomorrow if you want.
