Ethics-the only remedy!
1. Well, anyone who looks at child porn should feel guilty for one thing (I doubt the sick people do though!) but as far as legal punishment goes there's really not much you can do unless there is a way to know who exactly is viewing it.
2. There is a punishment for those who post such content, it's called child abuse and sexual abuse and if they're caught then they face charges.
3. Again those who produce the content face the charges of sexual abuse and child abuse, if they're caught.
4. IF that is the question, if there were more laws concerning this issue then yes-as it is now people can claim that it hinders "freedom of speech" by limiting such content. And IF law enforcement could have the resources to monitor who is viewing the child porn on the sites. And IF more people had morals it wouldn't even be a problem!

This is a difficult area for many reasons. It is often hard to determine if a subject is underage for one thing. And it is nearly impossible to prevent material originating in less restrictive countries from entering the U.S.A. electronically.
In answer to your questions:
1. In this instance you would have to prove that the search was indeed purposely for child porn. This can really be difficult as it often pops up unbidden. Having a punishment for searching would be useless in my opinion.
2. This would be distributing. The punishment should be less than for producing.
3. These are the ones that should be targetted the most. They are the ones actually exploiting children first hand. Heavy prison time would be appropriate.
4. Probably not. As mentioned before, much of this material originates off-shore. Prosecuting the distributors is helpful, but does not eliminate the source. And I am sure any hard-core distributor and/or producer is smart enough to use tactics such as a decent proxy to disguise their IP address.

Not that I agree with it.. But most of the child porn is porn that has been shot with people of legal age. They either just look several years younger, or has been computer edited. Most of the child porn that is of actual children are being tracted and in the process of being prosecuted. Sometimes it takes a while to trace and gather enough evidence to actually arrest, but...
Sometimes, the child porn is coming from other countries where US authorities would have no jurisdiction over. While they may be able to trace the people in the states downloading it, they would have to proove it is actually a minor in the pic in order to prosecute them.
Also, the people who like child porn avoid getting in trouble by using animated or illustrated images and video. Not a thing illegal with that.
So no, it really cant effectively be prosecuted because there are so many ways to get around the laws that are in current existence. The law needs to find a way to catch up to technology. And then when illustrated things are consider, does that fall uner free speech?

You can not prosecute people for what the read or watch even if you find it distasteful, without inviting the nanny state into your home. Making child porn is illegal because it victimizes children, and so is distributing it for the same reason. But unless it is done in the US we have no jurisdictions so you would need an international law, and we have seen how well that works if countries do not choose to abide by it.

um, yeah im pretty sure its illegal. im doing a research paper on child abuse for my collage essay, and this is one of many topics im going to talk about. it doesn t really matter what state or country you live in, child porn is a huge no no. in the united states, its very much illegal to own, but its also illegal to download and to view. people who make child pornography should be punished by death and people who watch it should have to watch the people who make it be put to death. end of story its illegal and is frowned upon.
