Hi, i was recently sent divorce papers, my husband is missing though, i found out the papers were made by his brother in law , he had gone to his own lawyer. the divorce papers just had the complaint, i was told it was supposed to have affadavits and other things too, plus no where on the complaint was a signature of my husbands, just the signature of the lawyer. in my counterclaim i did mention that i dont think my husband sent these papers. can anyone just go and fill out papers for another person?

i haven't hired an attorney because i can't afford it. my husband has been missing for 3 months now and i can't even pay my mortgage. i'm in a terrible situation, his family wanted us to get divorced and now they've told him lies about me and i dont know where they are hiding him.

can i ask the court for a copy of the document that has a signature to let them know its not my husbands? because the court said that they submitted the other affadavits to them, they just never sent me a copy, which they were supposed to.

Not legally. Perhaps the brother in law know the where-abouts of your husband.and is trying to cheat you out of your husbands property. I would not answer the papers, I would go to the police. Have you filed a missing persons report?

You are not stupid and this is likely fixable, particularly if you filed a counterclaim as this means you will appear before a judge who will more than likely cut you some slack if she possibly can. :) There are normally attorneys available for those who can't afford it and you really do need one ASAP. Go to the website of your state's bar association and find the phone number or website of your county's bar association. Call them and ask for "legal services" or an attorney for indigent people. When you make the appointment be sure to explain it is urgent and why. You may have only a certain number of days to take the appropriate action. Whatever you do, do not sign anything given to you from the other attorney until you have your own attorney read it.

Uhm, no. 3rd parties can ONLY attack voidable marriages. If there is some impediment to your marriage, then it can be filed by someone else. I suggest you get an attorney. You did a stupid thing by answering the complaint on your own.

nobody but your husband or you can file them. I would press charges against him for filing false documents.

he needs to sign & have a noterized signature.
