I was injured (skin burnt during routine wax and top layer of skin removed) at a salon. I've since healed but am angry because it should never have happened and then when I called to simply get my money refunded was treated very badly by the store director. I have pics of the injury and have typed up a legal professional letter to mail to corporate. I needed to know if I could demand a refund (I never followed through w/ the store director because of how I was treated) and reimbursement for my medial expenses (prescription for burn ointment) as well as money for pain/suffering. Can I state if I dont' receive that I will take them to court? Or is that threatening? Thanks!

Don't mention legal action when you ask for the refund/reimbursement. If you are going to take legal action, don't talk about it, just do it. Your position seems reasonable to me and the company higher-ups may well cooperate. If that doesn't work, and you feel like pursuing the case, you will have to decide whether it's worth the trouble. You could try to find a lawyer, but I have a feeling this case will be too small for them. You could also take them to court yourself, but again that will take up a lot of your time. Another idea is to complain to your state's attorney general about the incompetence of the person who injured you, which should get their attention.

You can send a demand letter for a refund yourself. (It sounds like you're entitled.) But, you should consult a personal injury attorney ASAP.

Unless the company fears the person who makes the demand will cost them money then they have no reason to pay. So you will have a much better chance with an attorney representing you.

If you write the letter yourself you can tell them that you will consider legal action if they don't give you what you want. But, they won't take it seriously.

You can always threaten legal action, but I wouldn't do it in a personal letter. It looks lame and drama laden. Any threat of legal action should be on a lawyer's letterhead. It has much more credibility.

Just outline your experience, send copies of the bills, and tell them that you'd like a refund and reimbursement of your medical expense.

Send the letter by registered mail, so you can track who signed for it and when. It just makes it stand out from the regular correspondence.

Doesn't sound threatening to me. In fact, it sounds more than reasonable considering the circumstances. I would instead say that "I will be contacting an attorney" rather than "I will take you to court". But that's just me.
