The laws vary by state and each state has different obscenity laws as well as regulations on actors/actresses and how/where filming has to be done. You need a lawyer to help you b/c there are states where you can film but technically it IS illegal but it's sort of like the blue laws, you probably won't be charged unless you ruffle someone's feathers so ages checks, etc. are an absolute. Look it up on the web there's some good sites which can tell you where to go for your state's laws. Good luck

To film with intentions to market the product, you need a permit, which no city authority will grant when you divulge its going to be a rated-X video. All porn movies you see on the market were filmed illegally. Once you finish filming, the next step of editing, mass producing, and marketing is legal.
Porn producers evade prosecution because filming porn is a misdemeanor; meaninng the law must actually serve a warrant while you're filming, and enter your film set. You must be very carefull in providing irrefutable legal documents to show the actors/actresses were all at, or beyond the age of consent (18). In 1984, Tracy Lords had used a friend's birth certificate to get driver's license saying she was 22, when in fact, she was only 16 at the time. Producers of her porn movies were charged with marketing child porn when it was revealed she was a minor when she started in the porn industry.

> All porn movies you see on the market were filmed illegally.
Nonsense in the US by the first amendment.
Porn is not illegal unless it is obscene is a legal sense.
Not matter what stage of production or distribution it is in.
All legit web sitems make mentino to a statute regarding keeping track of performer's ages, they almost always cite the legal code on the front page before you enter.
Find such a site/cite, and google it.
Also check teh web site for "Adult Video News (AVN)", the industry trade journal. I am sure you will find more legal, business, and technical advice then you can fathom right now....
