Are you expecting to find some logic in the law? Sorry to disappoint.

Similarly, how is it that a performance becomes copyrighted if, and only if, it is recorded in a fixed medium -- even if nobody ever watches it again?

In my personal opinion porn is a movie wth actors and actresses the actors and actesses get paid to act out sex scenes and there are releases involved ,legal forms,and ID exchanged and the films (In some cases they aren't) are sold online or in adult stores generally regulated by some form of tax or business liscence where the state or government is recieving a portion of this through taxes or other licences Protitution is a private negotiation between two people who are having sex and the person providing the sex is paid for the sexual acts and it is not filmed and there is no state or government control over these acts.

Prostitution is associated with lots of collateral problems, particularly in large cities--transmission of disease, prostitutes subject to violence or even death, nuisance from johns driving around the same block 100 times to find a hooker, people having sex in alleys, etc. Porn is usually consumed in privacy and causes no particular nuisance to the general public. And don't forget that porn may be legal, but its sale is heavily regulated. I'm not taking any position on porn or prostitution, but these are just some thoughts.

Agreed it is the same thing the actors and actresses get paid for having sex.

Prostitution laws are restriction on commerce for (ostensibly) public health reasons.

Porn is production of entertainment and is protected speech under the first amendment.

Apples and oranges, really.

Prostitution is defined as two people engaging in physical intercourse of some kind, where one is paid for their participation.

Pornography is any sexually stimulating, representation of visual or audial sexual stimuli: not actual physical, sexual intercourse: these can be drawn pictures, photographs, phone conversations, etc.; money can change hands or not, doesn't matter, as long as there is no actual physical contact between two people.

Yeah strange isn't it? But the people in porn aren't paying each other to have sex, someone is paying them to act (pretend to be having sex). Cool isn't it?

With porn, youre not paying someone for sex; youre paying to watch a movie, so it's not the same thing.
