i was laidoff from work and while checking on cobra for my insurance I was informed that 1 month prior to this my insurance was dropped because of no premium paid. But the money was still taken from my check, nor was I notified of the fact.

It could be a mix up, but if you can talk to someone in the payroll office, ask them why your coverage was cancelled but you're still being charged.

If they're doing it knowing coverage was cancelled, then it's probably fraud and you'll need to talk to a lawyer. But try talking to the company that laid you off first, if you can.

reguardless of how you look at this, it is fraud and legal action should be taken. you should also report the employer to the frederal bureau of labor and investigations. they can help you get the money back that was taken from your checks as well as submitting the legal action to take agianst this person and or company.

call your employer and ask for a copy of the cancelled check for insurance, tell them you are applying for cobra, they should then tell you, if they dont ask for your money back in writing, certified letter, if they do not respond get an attorney.

You need to confront your old boss about it, or better..if you had a Human Resources department...talk to them. It may have been an honest mistake that you can get resolved on your own. If you worked for a small company, they should have known better, but if it were something 'corporate'...something like that can be a clerical error.

If they cancelled the insurance, you should have been advised and the money should not have been deducted.
