My parents divorced when I was four, I am currently 21and attend a University. This past June I had a car wreck and since I have had a lot of problems stemming from the wreck. (Fainting, Migraines) and had to have a lot of test run. My Dad is required per court order to have insurance on me, pay half of the bills stemming from medical expenses, and pay child support. His insurance has not paid anything on my medical bills and I owe almost $5,000. I have paid my co-pays and all that, but he hasn't help with anything. One of my major bills from the hospital is over $3000.00 and I can not pay it. I have called him several times and asked him to send me a little money for the bills, so they won't go to collections and he refuses to help. ( He lives in another state) The hopsital is about to send it to collections and it will go on MY credit if some of it is not paid. I have contacted his insurance company to see why they have not paid on it any, and can not find a good reply. Yet, he has

admitted to receiving a check for over payment to one of my doctors for $300.00 and refuses to send me the check. THAT is money I paid!! I don't know if I should just gather all the medical receipts, bills, and other stuff i have paid for (with no help) and sue him for one lump sum or what, I am so sick of my parents not doing their job and taking care of me (this has been going on since they divorced and I haven't had much financial help from either of them) If this goes on my credit it can keep me from getting a student loan and I won't be able to finish school. What do I do??

What do I do about him pocketing MY money. The whole fact is, that BY LAW he and my mother are supposed to take care of this and they aren't. Since legally they are required to, do I have a case?? I don't ask them for anything else and have worked since I was 16. (My senior year of high school I average 45 hrs/ week at my job and still graduated on honor roll) I had to quit recently my job because of medical-related problems and stress with school. All I want them to do is what they are by law supposed to be doing. I moved out my junior year of high school because they weren't taking care of me and have basically provided for my self since then, but I think that they should be doing what they are court ordered to be doing.

Altho this is a crappy situation and you have been dealt a crummy hand of cards in life---you are 21 years old. I think its about time you stopped looking for mom and dad to "take care" of you. Thats my soap box answer.

Now my other answer. If you are supposed to be insured under a policy by your dad the beef should be with the insurance company and not your dad. The insurance company is the one not paying up. You have done your part in paying the co-pays etc. You need to make an appointment with someone at the accounts receivable office at the hospital and explain all of this to them They should be able to help you get this straightened out. If not, then they can put you on a payment plan of some sort. Its good that you are thinking about your credit in this because you are right it will go on you and effect you for a long time.

Bottom line--make that appointment and talk to accts receiveable. AND be sure to keep good records including dates and names of people with whom you speak.

Contact a lawyer and see if you have a case. remember the lawyer will want paid also, so make sure that whom ever you sue, has to pay all legal fees. Go for it, after all it was agreed upon when you where 4. Your mother might be held responsible also. Don't talk about it get out there and do it.
