In case you aren't familiar with the story, this took place in Houston. Horn is defending himself saying he was protecting his neighbor's property as well as their neighborhood. Many people here in Texas are saying he should not be charged.

I am asking "What do you think?" because I'm wanting to know people's OPINION. So SOME people might say "should or shouldn't have" isn't the issue and that Horn was within his rights, but they have mistaken the question...and yet will still excercise their opinion anyway. Because I live in Texas and I AM familiar with Texas law, I know that under penal code chapter 9, JUSTIFICATION EXCLUDING CRIMINAL RESPONSIBILITY, SUBCHAPTER A. GENERAL PROVISIONS, one may use deadly force to protect property if he reasonably believes that "the land or property cannot be protected or
recovered by any other means". That is where we enter grey area, which is why I ask what others think. If one is so sure of what Texas law states, why is the Harris County DA's office undecided on whether to indict him? Also, I looked at some website called texaspolicecentral.com, which someone used as a source for their supposed knowledge of Texas law. It is NOT a government website, but rather a website created by a bored Texas third watch patrol supervisor. It features SOME Texas laws, but also includes sections such as "Poems & Letters", "Police Humor", and a "TPC Store". The "About the Webmaster" section features the "webmaster", complete with a link to his "Cop Chat" board, a Paypal link for donations to his website, and a picture of him with Kelly Clarkson. Is that what's considered a reliable source these days?

Murder. He wasn't under threat from these two guys. They didn't enter his property and present a clear and present danger to him. And I own a revolver and know when to shoot and when not to shoot. Mister Horn never learned that.

It doesn't matter what people think. Under Texas law, a person can legally shoot anyone who is committing burglary. The thieves do not have to be armed. They do not have to act in a threating manner. It doesn't have to be your property. This is specifically stated in section 9 of the Texas penal code. I have included a link, so check it out if you do not believe me. The only reason, charges might be brought against him, is public pressure. It will be pointless though, because he was acting lawfully. If people don't like it, they can have the law changed but they cannot punish someone for acting within their legal rights. The simple fact of the matter is that certain people with agendas, want to make this about race. This will keep the issue of racism on the front burner and garnering the attention they feel it deserves. Joe Horn should be looked at as a hero. Like it or not, more of this will start happening if we do not control our borders. The men who were committing the robbery have a criminal conviction list a mile long. I know that one of them had been deported before, and possibly the other one. They had no problem getting back in to our country to commit more crimes though. Yea, lets waste a bit more time building that fence, so more innocent people can be placed in danger.

I was unaware Pasadena, Texas had become a Mafia hitman's retirement community. truth be told Pasadena PD had a undercover Police Officer pull up as the shotting occurred and he witnessed the situation you call an execution. The two men had the neighbors property in hand and no time to plant it as you insinuate. The man urged the cops to hurry and yes was told not to step outside, but once outside he was suddenly confronted by two men running at him crossing his lawn carrying stolen loot. The attempt to stop and detain the two men with the warning "stop or your dead" was quickly over ruled by the actions of the men running at him across his lawn putting a fear for his life in this old man. As his back was turned to the second man he quickly swung around fearing this man would be jumping on him and fired in fear My question is would you have cared if when Joe Horn stepped out his home he was stabbed or shot and killed. Just another sad statistic, right.

If you were familiar with Texas law, you would not ask this question. Horn was within his rights, and the law. Other states have different laws. In Oregon, Horn would be charged with murder, as he can't even defend his own home/property against invaders who are now outside. In Oregon, when a burglar/etc gets past the threshhold-outside your home-you have to let him go. He can stand there,and shoot at you, but you can't shoot him. In Texas, if you can prove he was committing a crime-even against property-you can chase him to the state border and blow him away.

Should, or shouldn't, is not the issue. Under TX law, Horn CAN"T be charged. Give him a medal, and post him outside some of the local shopping malls.

well I'm like this maybe we should give him the key to the city and a man of the year award this guy is my hero and i don't care who you are a low life thief deserves what he gets in the end . and also people in Florida and Texas don't play you try and play that street punk stuff in those states they will leave you lying in chalk

You can't shoot people in the back who are of no immediate threat to you. What he did was wrong.

Your posting made me think you were talking about the long-time New Orleans Saints wide receiver now playing for Atlanta. It's a different Joe Horn, though.

Wish I had Joe Horn living next to me. I appreciate when a neighbor watches my place for me. He should NOT be charged with murder. That's crazy. He was protecting himself and his neighbors property.If they had not came into our country illegally and been committing a crime, this would not have happened.If you say they couldn't speak English, this shows how important it is to learn it. We don't want their thieves and drug dealers.Or their illegals. This man should get a medal. He just started a good "neighborhood watch program."

He should be given a medal not charged with anything. These two criminals (both illegal immigrants with form) were given a reasonable warning . I hope that this will deter other would be robbers and send a message out to all criminals

there was no threat to human life he is a murderer simple as that, he is also a racist if the two guys were white and not blck he would not have shot them , lock him up for life

BTW, the two thugs were illegal immigrants. I guess they were just commiting the crimes Americans are too lazy to commit.
