when renting an apratment & they do criminal background checks, how far back can they go? Is it 3 or 5 years?

They can go back as far as they want to, or as far as records are available. There is no statute protecting an ex-convict from being denied a rental, since ex-convicts are not a protected class under discrimination laws.

depends what state you are in. Should be 3 years though...normally.

The question is have you "EVER" been convicted, not have you "recently" been convicted.
