Well i`m not sure how to explain this. My wife and i were offered jobs out of state with free housing . The only thing we have to pay is internet and tv
Well she has 3 kids with an ex that does visit his kids when he is suppose to.
They have 50/50 cus and she has the kids
So my wife called the ex to ask if it would be ok to move the kids out of state and explained to him that we would live rent free. And he flat out said no. Mr ex has 5 dui`s and a few other things
We are not trying to take the kids away from him she told him he could have them all summer and when ever they have school vacations
Both of us lost are jobs here and end neither one of us can find a job, there is just nothing here
We went to see a lawyer and they told us the wanted 4000 bucks
Well we dont have it and i dont know what elsa we can do. And these jobs will not wait for us forever
Like i said we are not trying to keep dad away from the kids we are just trying to better areselves

this is an evolving area of law, and it is going to take a court decision to resolve if the parties can't do it themselves.

find another lawyer if you didn't like the first one.

but I bet you don't work for free, so expect the lawyer to want to be paid for his time and expertise as well.

Quite frankly, if you are in the USA then you can move if you want to. It is up to the person challenging the move (the noncustodial parent) to prove that the move is NOT in the best interest of the children. You don't have to prove anything, nor do you owe anything to the noncustodial parent. Please note: Visitation and Child Support ARE SEPARATE. Just because a person does or does not meet their visitation is NOT grounds to change their child support obligation.
