you report them to police.
you ask the bank to clean up the account and repair any damage to your credit.
nothing more to ask for or are you wanting punitive damages?

Your don't ask for anything. You do DEMAND the account be closed and ALL records of it be removed from your credit report. You also tell the bank they WILL pay for any costs associated with recovering from the Identity Theft. If they are not cooperative, add your attorney's fees to what they pay.

I had a similar situation occur to me only it was a checking account. He was caught and given one year in a state prison. I don't know what happened to him after that. I could have preferred charges but I decided to allow the state to spend the money and prosecute him. Essentially I won. Incidentally, the bank not only refunded the money taken from my account but they paid back all interest lost.
