the gal may be interested on tht time but it does not mean tht adults wl rape on MINOR(LESS THAN 18YRS)

Your talking about the one in Australia right? Well apprently the reason for that is the consent age over there is 12 ( WOW.....). Also the people who did it were "Natives". Apprently when these natives are sent to jail they have a high suicide rate. In other words the Judge ( Who is a woman) thinks that putting them away is good as a death sentance. The girl apprently did say she consented to it but iam pretty sure most people can agree a 10 year old can NOT consent to sex. This is very stupid and most people are apprently outraged over there.......really hope iam talking about the right case.......

I have been rapped by multible men and i HATE it I am sorry for that girl. it is scary getting rapped and when people tell you it is your fault it is the most god awful feelings. That girl must ne shooken up. if i could i would give her a hug. I was rapped just about everyday for a year by one man, i tried to tell people but they said i had an over active mind. ( i was 7 at the time) The person who did it was also doing to three of his sisters ages from 9 - 6 years old. He went to prisin for the oldest girl people believed her. He is now out and still people dont believe us this guy is a horrid person. I was also rapped when i was 9, 12, and 14. These men were bigger then me much bigger and i couldn't fight them off i just recently told my family about some of them. for the longest of time i thought they still wouldn't believe me, i was proven right. some many people are out to hurt but so few are out to heal.

Now this case CANNOT be one relating to India & under the provisions of Indian Penal Code, 1860. Section 375 of this code clearly provides A man is said to commit "rape" who, except in the case hereinafter excepted, has sexual intercourse with a woman under circumstances falling under any of the six following descriptions: -

First: - Against her will.

Secondly: -without her consent.

Thirdly: - With her consent, when her consent has been obtained by putting her or any person in whom she is interested in fear of death or of hurt.

Fourthly: -With her consent, when the man knows that he is not her husband, and that her consent is given because she believes that he is another man to whom she is or believes herself to be lawfully married.

Fifthly: - With her consent, when, at the time of giving such consent, by reason of unsoundness of mind or intoxication or the administration by him personally or through another of any stupefying or unwholesome substance, she is unable to understand the nature and consequences of that to which she gives consent.

Sixthly: - With or without her consent, when she is under sixteen years of age.

Explanation: - Penetration is sufficient to constitute the sexual intercourse necessary to the offence of rape.

Exception: -Sexual intercourse by a man with his wife, the wife not being under fifteen years of age, is not rape].

Here you state that the dealing judge held that this 10years old girl was interested in SEX & she agreed to do it with nine men cannot be from any imagination of mind be correct judgment where the provision of section 375 IPC clearly provides Sixthly: - With or without her consent, when she is under sixteen years of age.
Even if a girl of less then 16 years agrees for such sex still this will be held as RAPE under this provision & punished under section 376 of the Indian Penal Code. This the correct legal position as far Indian Criminal Law is concerned, I cannot say about Criminal law of other countries how they look such cases of sexual offence specially relating to minors of such tender age, but in India this law is very clear & if any trail judge pronounces judgment such as this is absolutely wrong in doing so & its a fit case for appeal where such judgment will be held illegal & against the provision of the law of the country. In such a case the maximum punishment as provided under section 376 of IPC rigorous imprisonment for life & heavy fine, as this was a gang rape done with a girl less then 12 years of age.
