How long to I have to file attemted fraud charges against a cheveron dealer on top of a 7000.00 dollar swindle for my car being repaired if this took place in 2001. After complaining to the Cheveron coporation the next day the station had a new sign which read Mobile. Cheveron pulled the franches from the dealer and I was told that they were aware of what this dealer had been doing. Does any no what my recourse could be and what recourse do I have againt Cheveron coporation. Neither the dealer and Cheveron corporation refused to refund my money. None of my money has been given back to me as of this date. I live in Texas.

What do you do when Cheveron knows that a dealer that is under thier direction is stealing money from is patrons through car repairs. One report after another was submitted to Cheveron about this dealer but nothing is done until one bill reaches almost 8,000 dollars in repairs. Once Cheveron was notified that day of the incedent during the wee hours of the same night sends a crew out to the dealer and removes any sign that this dealer represented Cheveron. When the dealer is approched again they threaten to call the police and have you arrested for trespassing. The twist is that the dealer is from Paskistan and is illegal in this country. The question is: 1. Can the dealer be criminally prosecuted. 2. Is Cheveron liable.

The statue of limitations for torts is normally 3 - 5 years (not sure of the limit in TX). It is unlikely that you would have a course of action against Chevron corporation. They did not commit fraud against you, the dealer involved may have.

You should have filed suit against the dealer once they refused a refund. You probably should speak to a lawyer to see if there are any extenuating circumstances that will allow you to sue this late after the action occurred.

1. Can the dealer be criminally prosecuted. - No. The statue of limitation has expired for any crime that may have been committed

2. Is Chevron liable. - Not likely. They don't control the stations, they franchise them. Additionally, the statute of limitations has expired.

Just being from Pakistan does not make the owner illegal. I am sure you have not determined his legal status.

By the way, you never have mentioned exactly what you feel they did wrong.

youre past the statue of limitations by a long shot! i think you have 2 years not 6. thats a really long time to wait. id get a free consultation form a lawyer (most all provide this without contractual agreement) and see what they say each state varies but i believe in the US the statue of limitations is 2 years.

Dealers are indpendant businesses. Your beef with him has nothing at all to do with Chevron. That's just who he used to buy his gas from.

In any event, "who" is responsible is irrelevant - you are *long* past the expiration of the Statute of Limitations.
