How would those on the left treat the detainees (being they are not citizens of the US our constitution does not apply or does it?)

Let me tell you that Jose Padilla IS an US citizen. Not that I really like him, he seems to be a pretty bad guy but that doesn't justify the kidnapping, the torture, the illegal detention, the lack of legal process, the violation of the rights granted by the Constitution.
Do you really think that the Constitution says that the rights are only for citizens? Can you imagine the consequences of such thing? You can see them now. There's a constant decline in visitors to the USA due to the new "security regulations". They feel that the rights granted by the Constitution don't apply to them. The funny thing is that they don't apply to you and the other citizens either.
If this idea keeps growing, the USA will become an isolated country. Something that misguided people like you would certainly cheer. But you're missing a critical point here, the USA has become dependent of others to survive (with the current level of wealth). Its producing less and less and importing more and more. Its production is shifting from tangible goods to intangible goods. Do you think the USA can survive in isolation?

There are laws to deal with crime. Terrorism is crime, real crime, damage to persons and their property. There's no need to use other methods other than the legal ones. Besides the principles, something that you don't seem to value much, it's the only way to know that those who you're paying to do the job are not kidnapping anyone from foreign countries to justify the high cost of the war. Or why do you think they want to keep it in secrecy in Guantanamo?

And, from a practical point of view, what do you get from torture? The truth that you don't know? Or what you want to hear? When are you going to ease it or stop it all together? Where are you leading your victim? You've been paying all your life (working life) through taxes to support the biggest intelligence organization ever in the history of mankind. Electronics equipment, psychology training, spying techniques, weapons. You name it, they have it and they paid all that with your money. And now they have to torture to get information. Don't you feel like a sucker?

Most everyone believes in torture, including you, when it is no longer convenient to believe otherwise. If you and/or your loved ones were about to be murdered at the hands of terrorists, you would be in favor of any means possible to stop them, even if it meant pouring water up the noses of a few of those who might be able to save your lives by divulging information. It's quite another thing for you to sit warm and safe in front of your cozy computer and say you are against torture.

The Supreme Court has made it clear that the Constitution does not address this issue. It does however address treatment of accused people citizen or not.

It is obvious some people have made a carrier of Gitmo.

I'm all for chemical interrogation. Check the prisoners vitals to make sure they can handle some stress then fill them up with Sodium Pentathol and LSD. You get fast results, then you tattoo "I ratted on AlQaeda" across their forehead, and drop them off in Waziristan.

First, if everyone being detained at Gitmo is a terrorist...why haven't they been charged, tried, convicted, and sentenced to death?.....If the alleged terrorists turn out to actually be terrorists, or have connections to terrorists, I would have no problem with putting two in their chest and one in their head, and dumping the corpses in the ocean for fish bait. What I do have a problem with is detaining someone for an unspecified amount of time, with no legal representation, and no charges being filed, whether they are US citizens or not. If these people are criminals...charge them as such... but we shouldn't be in the business of basically imprisoning people for as long as we see fit, just because we classify them differently than if they were US citizens. I say either charge them, or let them go.

They are deemed "enemy combatants," a broad term that could include you or me or anyone the President thinks is an "enemy combatant." The people in GITMO are detained without formal charges. They are denied legal counsel. They are denied access to the evidence against them. They're not citizens of the US but they are Prisoners of War and under the protection of the Geneva Convention. Torture only produces false confessions. How much WaterBoarding could YOU take before you admitted to whatever it is that you thought they wanted you to admit to? How long could you stand in a stress position? Did you know the detainees in Guantanamo Bay as well as the people of Iraq and Afghanistan all have access to Universal Health Care courtesy of the US tax payers? And we can't even get that here in the US! We can adhere to the guidelines for POWs under the Geneva Convention and use the means allowed for us to extract information without resorting to torture. We are the UNITED STATES of AMERICA and we are BETTER than that! Even if YOU and your "president" aren't!

To answer your question;

Set them free to blow up Americans in short, If all of us could be "Tortured" like the detainees at Gitmo. The average detainee at Gitmo has gained 20 lbs on a custom diet prepaired by chefs. Health care is provided free of charge.

itsyourworld_changeit...it is real obvious to be a Top Contributor on Yahoo Answers you just have to put words on a computer screen...Read the Geneva Convention much? If so you would know that UN-UNIFORMED people caught on the battlefield fighting are to be treated as ILLEGAL COMBATANTS or SPYS...which means they can be shot on site...when the terrorist start wearing Uniforms, quit fighting from Churches and Hospitals, and cutting off people's heads...then they will be treated like Prisoners of War...they are lucky we do not shoot them on site...

I agree with you andy, I don't have the answer either. I am disappointed with the Supreme Court and some of our law makers that don't do the right thing.
