The Pats will trade away this pick for several lower picks and then get good players with all of the picks, rather than take McFadden with a 3 or 4 pick. That's the way Belicheck works...he's an evil genius.

Yeah, and I'm not sure they have any such 'sweet deal'. They're best trade is Gore, and they won't trade him. And even if they would, I'm not sure the Patriots are convinced Gore is better than a top 3 pick rookie in the long run...
But yes, 49ers will not have that pick, that's why you never trade unconditional picks in my opinion...

No clause or protection, the 9ers could try to negotiate, the Pats probably wont bite unless its a real sweet deal.
