Oh dear. Depends what they actually charge you with - it could be either theft, fraud or obtaining goods by deception - or all three. Each one carries a threat of a prison sentence and believe me, the court will not look lightly on the fact that you were in a position of trust when you took the laptop - that is another strike against you. All you can do is offer to return or replace the laptop (and mean it) and apologise to the judge & hope and pray that he is a nice judge in a good mood and doesn't want to make an example out of you. What is on your side is that the prisons are full to bursting at the moment and you could get a hefty fine and community service but be prepared for the worst - it could happen xxx

Theoretically, yes. It's a breach of trust type theft.
Take into account prison overcrowding, the loss has been restored to the loser, previous good character etc etc, unlikely. Most likely is a community service order (unpaid work).
Remember the prosecution have to prove that you intended to permanently deprive the loser of the porperty. They usually succeed in doing this by getting the defendant to admit he was going to keep the property.

Well anything that cost over $1000.00 is considered a felony. If a petition has been filed against you and they win then you might face some jail time and a fine or if its your first offense you will probably just get probation and fines. If there isn't a pending lawsuit then I would just call them and let them know you have it and ask them how they would like you to return it. Hope I helped.

Yes, you probably will go to jail for this. It depends, in part, on the value of the laptop. You should be asking this question of your defense attorney. If you do not have one, you should tell the judge that you want one.
