Ok heres the deal. Me and my Girlfriend wanted to move out. My dads house was not being used so he let us rent it. My girlfriends sister was getting kicked out of the room she was renting so i let her stay in my dads house. My girlfrinds sister is a pothead so i told her, i dont care what she smokes just not on the house. Well they broke the rule and i told them they had till the first of next month to get out. next day my girlfriends sister's boyfriend decides to bring his friends and smoke on the house, so i want to kick the sister out and her boyfriend immediatly. he says i cant legaly but we have no contract or nothing. i was letting them stay in a room if they help pay rent. so can they be kicked out legaly?

If they have no proof of residence (DR license with this address, utility bill paycheck, mail delivery) they are guests. Ask them once to leave; then Call the police and have them arrested for trespass

Once you allowed them to live there, you now need an eviction notice filed to get them out. Does not matter if there is a lease, rental agreement or anything else. This came about because of conflicts when people started living together but then had a spat and wanted the other one out. Courts made it mandatory to file eviction notices.

It's a private home with no lease. You can kick them out whenever you want. The boyfriend has no brain cells left. If they are doing illegal activities you don't have to give them notice of any kind. Let him take you to court...what is he going to say to a judge...you kicked him out because he broke the no pot smoking in the house rule?? I don't think so.

Yes the guy is stupid you may not have a contract with him but that means you can kick him out whenever you feel like it.
But just to be safe get a lawyer.

if that is their home, paying rent or not, that is their residence so you need to follow formal eviction proceedings against them. If you are also staying there, you can always call the cops next time they smoke out in the house, or you know they are holding, but be prepared for family reprocussions .

Hi,
you don't have any contract so they can be kicked out at any time. If they refuse to leave call the police and have them removed. What about asking your dad to say something, its his house.

You'd better get a lawyer for this one.
Landlord-tenant relations is a chapter of the law unto itself.
By being a nice guy, you end up being screwed. You need a lawyer. Next time, don't be such a nice guy.

Call the cops and have them physically removed if they won't leave on their own. They have no legal right to be there.

i think in most states you have to give tenants a 30-day notice, so to be on the safe side, give them at least 30 days.
