Based only on your description, I'd say it's almost impossible for him to win custody. He may however even end up getting charged for rape being you were only 17. Your age as a mother doesn't necessarily mean you would lose the child. If you can provide a safe, loving, healthy environment for this baby, you should be fine!

First of all what are you doing with someone that is 29 and you are only 17? If you were my daughter I would have had that guy brought up on charges. And if everything is true that you are saying about this guy why would you want him in your child's life? I would not even let him within a 100 miles of me or my child. Go to court, get child support set up,and if he pushes for visitation have it set up through the courts that it will be supervised with a court appointed third party person. And I highly doubt it that if this man wants to push for custody let him with his criminal background no court would give him custody. I sure hope that you have the support of your family. It sounds like that you will need it. All I can say is take care of your son, love him, and give him the best life possible. Remember he is the innocent one in all of this mess. He did not ask to be born. You made that decision. Before it happens again make sure that you are ready for it, and you are with a man that will provide for both you and your baby. I know some people are mentioning statutaury rape (cant spell), but most places it is under 16.
If he is using drugs, or you have suspisions he is, tell your lawyer and they can set up a drug test, if he is positive, there is NO way they will give him custody.
Seeing as how he has made little effort through all this, this is another sure sign he will not get custody.
Just because you are under age, doesn't mean they will frown upon you. If you have people helping you and you have been the main child care giver for the last while, you will surely keep your child.
If he has a past with the police, ANY past with the police or a record, the odds are in your favor dear.

With this in mind, questions arise as to which parent can more capably provide for the infant.
If your allegations of the father's "disorganized" life are true, your profile of being a capable Mom will surely influence the judgment in Probate Court.
Additionally, depending on what state you reside, the matter of you becoming pregnant prior to your legal capability of giving consent to sex may be prosecuted in a criminal court against the man involved.

Very, very unlikely. It's far more likely he will be arrested for statutory rape! he KNOWS this too. 29 and 17...that is a CRIME on his part. Is he paying child support?
He would have to PROVE you are unfit and that he is a better parent. Even then, judges lean toward the mother, and especially since you have raised the child. Don't worry about it. if he's on drugs, he probably can't or won't follow through.

Note the phrasing you used. "He's THREATENING..." He is just yanking your chain. If he truley wanted the child, he'd get a lawyer, and file suit. Until he does, just keep him away, and tell your child what a wonderful person his dad was.. Was...
As for the legality, keep in mind, he will have to admit to the court that he had sex with a minor. In most states, this is statutory rape.

Child custody is awarded to the one that is best for the child only... His age and your age has nothing to do with it, it is solely decided on who can give that child the best care.. Just be a good mom and you have NOTHING to fear.

He could file for custody but i doubt, based on your description, that he would get it. He could also get charged with statutory rape for having sex with a minor.
