Okay it was over the Thanksgiving break when i went up to my cousins Place to drink. NOw , I had a few drinks over his place and went over his buddies place to drink some more. Now here is where it happens, We get back to the apartment And I find that I left my phone somewhere...
So i automatically Im halfway drunk but halfway concious of where i am , I do something really stupid ...and I got outside to look in my car for the phone..but unfornately with my key wouldn't work,

Suddenly out of no where the cops come and Automaticallly accuse me of trying to steal a car..But really ...it was my car....


But while they were talking to me .My cousins girlfriend comes and says' that she is responsible for me..
My question is They didn't give me a breathlizer but they claimed that I was drunk..So my thoughts are they have no proof......Of me being drunk ..>I got my citation from the cop about a week ago in the MAIL because they mailed me it.
i was basically charged with an underage. in PA

Depends on the penalty; if it's a small fine, heck, you were guilty, pay it and move on.

Pay it and let it go. Police don't need to give you a test to see if you are drunk, they've seen it enough. I'm a firefighter and I can tell within 10 seconds if a patient has been drinking, it's part of the job.

You're young. Don't fight things which aren't worth fighting for. Pay the fine and DON'T do let yourself get caught in the same situation again because in the long run it WILL affect your adult life in terms of jobs and career.

They don't need a breathalizer in this case. You are under age, so the police don't have to show that you were DRUNK, just that you had been drinking. The officers observations (odor of an intoxicant, slurred speech, bloodshot watery eyes, etc.) will be more than enough for a conviction.

By your own admission, you are guilty. Pay the fine, and quit drinking under age.

Depends, courts usually will take the officers word for it. But if they didn't give you in sobriety field tests and no breathalyzer, I would fight it. I would try to get a public defendant so it doesn't cost you anything unless you got money to spend on a lawyer.

Your actions and behavior and the fact that they could probably smell it on you was proof enough for them to cite you.

it's just a fine... no big deal...
just pay it and put it behind you.
