Legally, one can construct a vessel. Depending on what State and Country you launch in determines the other stuffs. To launch a passenger carrying vessel in US Waters requires, x and y and z , check your local USCG AUX Station for that. A Masthead Rig, I think you are talking about Square Rigged, that is a matter of Height From Waterline. If vessel a has a Waterline to Topmast height of 79' it usually cannot safely navigate safely in any Marked Channels or Waterways. Want to build a replica Square Rig, better have some propulsion on her. A simple Diesel 10hp or more is ample. Catch a strong wind and a current and she will founder. The actual answer is yes you can, in most states in the US. If you plan on sailing her solo, sure, if taking on paying passengers or cargo, that is a different route. Check with your local USCG AUX station, get to know them and be happy.

I'd sure like to be Captain of all I survey, but to be realistic, it would have to be a fully-clothed authoritative figure, to whom I would bow and then go below decks to grease the poles.
