I have friends that have been kick out of their apt. just for been ilegal, that is the reason that the landlord is using to get them out, I know that a landlord can decide to use any reason to ask for the promises to be vacated but if that is the case shouldn't the landlord give the tenant at lease a thirty day notice to move out

Yes, there are statutes in many municipalities where a landlord cannot rent to illegals.

A 30-day notice is not required if the tenants falsified information in order to obtain the apartment in the first place. That is an exception...regardless if rent was on time or not.

PS: Big Deal Maker is half-wrong in his statement. There is NO FEDERAL statute against renting to illegals. This is locally controlled...no STATE has the law, but many localities do. However, even BEFORE 9/11, it was illegal to hire them in every state.

Yes the Landlord should give the tenant 30 days notice if they are current in their rent and are otherwise not causing any problems.
Most laws of this type that have been in the news have been thrown out by higher courts as soon as they went into effect.
Basicly if they were tenants in good standing the landlord blackmailed them to get them to move out.
Most responsible landlords would know before he ever accepted them as tenants, if they were illegal from their background check, then again with a good background check, presumably he might not have not let them move in at all , not because he was a "bad guy" but for very real and sound financial reasons.

Just for being illegal???? Illegal is illegal, well why not rent to escaped cons which is basically what these people are. They have violated the rules of the land, in that instance they have no rights, and yes should also be deported. Come here legally you will be welcomed with open arms, and given all rights that a citizen should have. Sneak in under cover of darkness to use and abuse our system you have no rights and are not eligible for employment or housing. The key word here is you are illegal!!!!!

I think he's legally required to give 30 days notice but he's banking on the fact that an illegal alien won't be complaining about it.

As far as laws which state that landlords don't have to rent to illegals, it would be determined by the State you live in. However, I doubt that any state would have such a law since it is discrimatory.
