If the person bringing the gift is the one who originally made, purchased, or otherwise had it to offer, then it still belongs to that person until you accept it.

The gift is yours by the fact that it is a gift and it is for you.

Of course you are a gift in and of yourself, birthday girl, and perhaps you were too busy avoiding the spanking they wanted to give you to see that that too is a gift.

Gifts are wonderous things. They are not always what we expect or when we expect them but they are gifts none the less.

My thanks to yur parents for the gift they gave us all in case they need to be told that again.

But philosophically speaking the gift belongs to you, whether you receive it or not.

As far as the post office is concerned, finders keepers, whoever gets the gift gets to keep the actual item. Then again it is crime to intercept someone else's mail if it is not addressed to your place of residence.

The gift can only belong to the person that you bought that gift for. If that person would never get it, then you no longer own it, and neither does anybody else.

if you don't recieve it because you don't want it then it's fair game, who ever wants it can have it. but if you don't recieve it because you are not home or something to that effect, then it's still your and whoever ends up with it is obligated to make sure you do get it.
