Are they still making spider man 4? in spite of Tobey Mac's little stupid behavior of money?

Don't need Toby for a good Spiderman flick. Do, however, need Sam Raimi to direct like he did in the first two and not make the same dumb mistake as he did in the third one (such as too much crying and too many villians.)
