My daughter is in a lease with two other girls. The one moved her boyfriend in and the two girls and boyfriend are making my daughter miserable. He is not on the lease and they are so rude to her and she is sick because she doesn't want to be there. They ignore her. Exclude her out of every decision there and will not speak to her. Three against one. They party loud so she can't sleep and etc. She did not agree on the guy living there and because of this they are all making her life miserable. Does she have a way out.

She did talk to the landlord and she doesn't seem to want to do much. She is concerned about the guy living there but is afraid if she says something it will make things worse. I say evict them all. I went there for dinner and they wouldn't speak to any of us, made loud noises, turned the tv off of what we were watching and ignored all of us. If I say something I fear it will be worse for my daughter when we leave.

The landlord said she would only let someone take her part of the lease is if the other girls were comfortable with it.
They hate her and don't want her to leave. They want her to be stuck there and miserable. I witnessed it and the tension while I was there was horrible. It made me sick.

Tell the manager there is someone living there who is not on the lease. If he refuses to move out, they can evict them all.

Edit: If the manager won't do anything for someone living there who is not on the lease, then I would pack my daughter's belongings and move her out. I would not stay there and help them pay rent for a place I am not comfortable living. If any of the utilities were in my name, I would shut them off too.

Move out.

If your daughter moves out and stops paying rent, then the roommates can either pay her share of the rent or not pay. If they don't pay, then the landlord will probably use his best leverage, the threat of eviction. But your daughter doesn't care if they get evicted.

The roommates can sue your daughter in small claims court, but that's a major hassle, plus your daughter can argue that they forced her to leave by making the house uninhabitable. Chances are they wont bother chasing your daughter.

There are risks, like having a credit rating blemish or losing an award. But it's not that easy chasing an individual for something as small as a 1/3 share of apartment rent. And really, the bottom line is that your daughter's health is more important than money.

Usually there is only one name on a lease. If that is the case here, and it is not your daughter's, then she can move out, and have no responsibility. If she is the signee, then she can have the others evicted, but she will have to assume the full rent payment.

First--talk to room ates, if they are so mean to her they may want her out so there ya go!! If that's not possible then go to the landlord....explain the situation and offer a buy-out option.

If she is not the only name on the lease then last resort she could just bounce and they still have to pay!

Good luck...I know that sucks!

You can pay some kind of penalty to break it, usually 500.00. The only way she can break a lease without paying is if she's in the military and needed for active duty.

She needs someone else to take her place. Have her talk to the property manager on how to do it right. (sublease)
