In California. If they have lived there more than 1 year you are required to give a 60 days notice. Each state will have there own tenant laws. Standard would be 30 days. But be careful that you are not committing retaliatory eviction.

Depends on the situation. Is this a rental agreement? If you, you need to deliver IN WRITING a notice to vacate the premises within thirty days of a rent due date. If you deliver the notice now, it will have the effect of giving the renter the month of January to vacate. However, if any rental agreements have been violated, you can serve a three day notice to vacate.
