I was falsely accused of forging a check because I sold something online, & the person wrote me a bad check-I didn't know it was a bad check. He wrote the check for over the amount he was supposed to send me, & after he sent it to me, he wanted me to western union it back. I didn't know. I was handcuffed & taken to jail for a day, but the judge threw it out & said it was a misunderstanding. They were going to charge me with a felony of forgery with 10 yrs. or more in prison.

I asked this question on Y!A before & they said I wasn't telling the whole story. I'm telling the honest truth. I didn't know I was being taken advantage of.

You don't have a record if the judge threw it out. You must be convicted to have a record.

There is a classic scam that goes something like what you wrote. The con artist contacts the seller of something in the paper or on the internet and says they want to buy it but that they have this check that must be cashed in order to pay you. They typically don't have a checking account because of bad credit, etc. in the past. They then send you a check from someone else, made out to them and endorsed over to you and ask you to deposit it and wire them the difference before the check can clear the bank. You lose your item and your cash and they're out nothing. If this is what happened, I would give the police copies of all of your communications with this person and tell them that you want to help them bust the guy. I do suggest that you not be so trusting of a stranger next time. Never send cash to anyone who's supposed to be paying you. It's always a scam.

Of course I believe you are telling the entire story. That is a big con that has been going around for a while. These sleazy people send someone money and overpay the amount using a fraudulent check. There was even something on TV abut this.

If the judge deemed this a misunderstanding then your record should be clear. You probably do not even have a criminal record if you were not convicted of this.

I am sorry you were taken advantage of in this manner.

you have no criminal record . but you have a court record and an arrest record. neither look good. if you have any encounter with a police person again, they will make an assumption that Bonnie ( of Bonnie and Clyde) somehow got away with something and got dismissed. does not matter if this was the result of someone elses mistake or how many times they call you to apologize they arrested you . it is difficult for you to be made whole. too much police power. exunging both records ... also create a record. now you will have three. LOL. it also costs YOU money and time to do this. i think you are a victim of a bad system

NO, you were FALSELY ACCUSED...that basically sums it all up. Besides, the judge even stated that it was a simple misunderstanding. Thus, you will NOT have a bad criminal record.

It will show as charges being dismissed, but yes it will be there. Getting it expunged or non disclosure would be a good idea.

If that is all there is to it then you can get the records expunged or have an attorney file a motion for non-disclosure.
And then there is no record.
