My husband was involved in an accident and the other driver is suing us. If the other driver wins the case do we have to pay or does the insurance company take care of it?

First, you should have your insurance company involved from the get go. If they are suing you for less then the amount of the policy, you are protected. (Watch for pain and suffering). You can hire your own attorney to respond to the complaint, or if the insurance company is handling you can ride their shirt tails. If the insurance company is not involved and does not want to be, you need a lawyer to drag them into the case. If they are not involved in the law suit, they are not going to pay. Talk to an attorney where you live.

First of all, if you have insurance, the insurance company is required to provide a defense for you. They will hire an attorney, and make all decisions with regard to the defense, including whether or not to settle the case.

If you have liability, then you will pay a deductible amount according to your insurance contract. If they sue and get a judgment for more than your insurance contract amount (or the limit of liability) then you pay the deductible, insurance pays their limit of liability, and you pay whatever the judgment is beyond the limit of liability. Some people carry an umbrella policy or excess policy to cover any excess judgment.

If you have insurance turn over the lawsuit to your insurance company and they will completely take care of it for you. If you do not have insurance you must either hire a lawyer to answer the lawsuit or the judge will issue a judgment against you. Lawyer in Texas.

Your insurance company should provide a defense attorney for you, unless your husband was not supposed to be driving, or was drunk, or committed some other violation of the law.

You will have to pay any money the plaintiff wins that is not covered by your insurance. If you only have a minimum of insurance, you may have to pay a lot. If you have no insurance you will have to pay all, plus hire your own attorney.

Hmmm...well the damage on his car should be paid by the insurance company, but if he gets awarded damages - that'll be on you! Go get a lawyer as fast as you can!
