I just realized someone silly might think I'm planning such a thing. NO. I'm writing a paper on the insanity defense and chose Presidential assassination as my subject. Thanks for much for your replies.

They can be tried in both.

Attempted murder is always a state offense. Attempted murder of the President or Presidential successor (next in line) is a Federal offense.

The double jeopardy provision of the Constitution does not prevent state and federal trials in this instance, since two different sovereigns (the state and federal sovereigns) would be trying the defendant.

As a practical matter, the Feds would take point.

While they broke both state and federal law, the feds always exercise their right and it is always tried in federal court.

in this day and age, count yourself lucky to ever even SEE the inside of a courtroom if you were to attempt something so foolish.

someone would put the word terrorist in your dossier and you would likely vanish.
