do i have to file for it ? will they automatically take it of his return? is there a waiting period.

If you have custody of the child list him as your dependent on your tax return. It will take longer to get your refund if owed. You will also have to provide supporting documentation basically showing proof of the child's residency as well as receipts for childcare or anyother related expenses. The IRS will do what they call a tie breaker. Where they look at both returns to determine who is elgible for the refund. In regards to prior year filings if he received the refund erroneously the IRS will go after him to collect their money. I would also contact your case worker and alert him/her with your situation. It depends on your state as well, some states will file a tax lien on your behalf. I attached a link for you to get some more info,

Talk to the agency that enforces child support where you live. They would be the ones to file the proper paperwork. If the child support comes through them already, they might file it automatically when they see he's in arrears.

If he is in arrears greater then one month, his refund is intercepted automatically. If he filed alone, you get the money right away. If he filed with a spouse, there is a 6 month appeal period you'll have to wait, unless his spouse has agreed to apply the entire refund to his case (They have to give her time to appeal and receive her portion of the refund).
