This issue has to be settled on the basis of a cardinal principle of law “WELFARE OF THE CHILD” the courts in India & even any where in the world follow this principle while deciding the issue of custody of child. The court has to see with whom the welfare of the child is most, on the basis of various factors such as the income of the both, general character of both, time that both can spend with the child, educational background of both, family atmosphere of both, CHOICE of the child with regard to the parent, age of the child (usually child of smaller age is given to mother), etc on the basis of all these the court assess with which parent the welfare of child will be most & give that parent the permanent custody but allows visiting rights & even keeping the child for some period of time to the other parent on regular interval of time/days. The parents are asked to provide in proportion for the maintenance of the child. Courts in India are always having a soft corner for mothers & a smaller child is given to her although no such specific intention of courts one find in writing but that is the usual practice.

In Indian Law, mother is given the custody of the child. Mother has all rights to take the custody of the child, she can also claim for the maintenance cost from her husband.

NO. you're unnecessarily apprehensive. Your in-rules are by no skill going to try this. besides, your daughter is in basic terms a new child. Indian rules won't enable to grant her custody to every physique else different than her mom. So, you be lifeless specific. not something of that kind is ever going to ensue. they are basically keen to verify you and your daughter through fact they love you.
