No, No. No, your not married to your husbands mistress.
So how can you file against someone your not married to.
Besides. Why would you want to spare him. He's married to you. He's the adulterice thats who you file against.
Sure it takes two to tango but the mistress did not vow to love honnor and obey you in sickness and in health as long as you two shall live. That was your husband The day he broke those vows to you he became the Adulter.
PS. Once a cheater always a cheater your better off with out him. You will never trust him again. There will always be the whisper in the back of your head wondering if he is cheating again.. So, to answer your question NO. Im sorry

No you can't, but in some states you can still file 'alienation of affection'. I wouldn't waste my time on either. Your husband is the one who was married; not his mistress and he is the one who committed adultery. There will always be some person out there in the world willing to see a married person; it is up to the married person to be true to their vows.

Oh honey, been there, wanted to do that.! It is all his fault but I hold her responsible too. I think you would have to file for a divorce and put this down as the cause but it most states it really don't matter. You ever heard of a "no fault" divorce. Now days, the court says it is no ones fault and they grant the divorce. Now long time ago, there was such thing as putting someone down as the cause and the husband would have to pay alimony for the rest of his life, it kinda was their way of making him pay for his infidelity. . . In some states...there is a suit you can bring against her called " Alienation of Affection". It is where you can actually carry her to court and hold her responsible for her actions. I saw this on Doctor Phil one day and I thought to myself, it is about time the HOES, are held responsible for their coming into a marriage and breaking it up. Talk to your attorney, there just might be something you can do to talk this woman down a notch. . . . . , just demeaning her in some way would be satisfying to you. . .

Im pretty sure instead of the mistress being too lovable, the wife was horrid and the man slipped away. Winning damages in court isn't going to make this woman any less of a wretch. Anyway, the case on the surface sounds ridiculous. Do you have a link to this story?

do you hear yourself saying that? your husband was the one who cheated on you in the fist place.why spare him?! leave the mistress alone.or jusr sue them both if that will make you happy. i think you just want to spare your husband coz you still hoping he will go back to you.right? well, he wouldn't be cheating on you if he loved you more than enough.so it will be a crazy thing if you are still hopelessly waiting for him. file a divorce, and move on with your life.without him. good luck.

Leave the mistress alone - it's the husband who is the problem.

Your thinking is a little convoluted, but I suppose anything is possible. You can't really want him back after he cheated on you, can you???
